The ministry of natural resources and environment continues training on extended producer responsibility

TN&MTOn the morning of September 14, 2023, in Ho Chi Minh City, the Office of the National EPR Council held a training conference to implement regulations on extended producer responsibility (EPR) according to the provisions of the Law on Environmental Protection. The conference attracted a large participation of associations, manufacturing and importing enterprises, and recycling and waste treatment enterprises in the Southern region.

According to Mr. Phan Tuan Hung, Director of the Legal Department, Ministry of Natural Resources and Environment, Director of the Office of the National EPR Council, the responsibility to recycle products and packages and the responsibility to collect and treat waste of producers and importers are regulated in the Law on Environmental Protection; Decree 08/2022/ND-CP of the Government detailing the implementation of a number of articles of the Law on Environmental Protection; Circular No. 02/2022/TT-BTNMT of the Minister of Natural Resources and Environment detailing the implementation of a number of articles of the Law on Environmental Protection.

According to the documents above, the producers and importers of 6 groups of products and goods including Tires and tubes; batteries and accumulators; lubricants; products with packaging (food, cosmetics, drugs, fertilizers, animal feed, veterinary drugs, cement, detergents and preparations for household, agricultural and medical use); electricity and electronics; vehicles are responsible for recycling products and packages according to a mandatory recycling rate and according to compulsory recycling specifications. Producers and importers can organize recycling themselves or can make financial contributions to the Vietnam Environmental Protection Fund to support recycling activities.

Regarding the roadmap, producers and importers of tires and tubes, batteries and accumulators, lubricants and products with packaging will carry out recycling responsibility from January 1, 2024; producers and importers of electrical and electronic products shall carry out recycling responsibility from January 1, 2025; producers and importers of vehicles (cars, motorbikes) will carry out recycling responsibility from January 1, 2027.

In addition, the producers and importers of 5 products and packages including Pesticides; single-use batteries; diapers, sanitary napkins, disposable wet wipes; chewing gum, cigarettes; some products and goods with synthetic plastic ingredients such as balloons, children's toys, shoes, clothes, disposable plastic items, disposable items, furniture, construction materials, non-biodegradable plastic bags must also be responsible for making financial contributions to support waste collection and treatment from January 1, 2022.

Also at the conference, representatives of the Office of the National EPR Council shared and introduced detailed regulations on product and packaging recycling responsibility and waste treatment responsibility of producers and importers; Instructions for registering, declaring and reporting on the implementation of responsibility for recycling products and packages and declaring responsibility for collecting and treating waste on the National EPR Portal that is being piloted.

Representatives of the Department of Legal Affairs, Ministry of Natural Resources and Environment and the Office of the National EPR Council directly discussed and answered many questions from associations and businesses related to two important contents: product and packaging recycling responsibility and waste treatment responsibility.

Immediately after the Law on Environmental Protection took effect, the Ministry of Natural Resources and Environment organized many conferences to disseminate and train legal regulations on the product and packaging recycling responsibility and waste treatment responsibility of producers and importers for associations and businesses across the country. However, because this is a new policy that affects a large number of businesses and people, the Ministry of Natural Resources and Environment will continue to organize many training conferences for businesses in the coming time, while combining it with different training forms to help producers, importers, waste recycling and treatment units fully grasp and access the provisions of law.
