Ministry of Natural Resources and Environment disseminates key updates of the 2024 Land Law in Hai Phong City
14/08/2024TN&MTOn June 28th, at the specialized conference titled "Key updates and important provisions of the 2024 Land Law" held in Hai Phong City, Deputy Minister Le Minh Ngan urged the Hai Phong City People's Committee to direct relevant agencies to swiftly develop guiding documents as mandated by the 2024 Land Law. This initiative aims to establish a comprehensive legal framework, ensuring a conducive environment for the city's socio-economic development, as well as safeguarding national defense and security when the National Assembly approves the early enforcement of the law (anticipated on August 1, 2024).
The conference was organized by the Hai Phong City People's Committee in collaboration with the city's Legal Dissemination and Education Coordination Council.
Attendees included Vice Chairman of Hai Phong City People's Committee, Chairman of the city's Legal Dissemination and Education Coordination Council, Le Khac Nam; representatives from various departments, agencies, and units under the Ministry of Natural Resources and Environment (MONRE); leaders from Hai Phong City's departments, agencies, and mass organizations; members of the city's Legal Dissemination and Education Coordination Council; representatives of district and municipal People's Committees; and members of the district and municipal Legal Dissemination and Education Coordination Councils.

In his opening remarks, Vice Chairman of Hai Phong City People's Committee, Le Khac Nam, emphasized that after over ten years of implementing the 2013 Land Law, the city's land management efforts have achieved significant results, creating a comprehensive legal framework for the rational, efficient, and economical utilization of land. However, the practical application of legal provisions related to land management and usage has faced numerous challenges, such as land clearance, compensation, support and resettlement, administrative violation handling, and the establishment and management of land databases.
The implementation of the 2024 Land Law and its guiding documents is of particular concern to Hai Phong City. "The Hai Phong City People's Committee identifies this as one of the city's key political tasks in the coming period. The dissemination and in-depth legal education regarding the Land Law is essential to equip judicial and cadastral officials, as well as other civil servants and public employees across the city, with knowledge and new legal provisions. This will contribute to better land management and the effective execution of land-related public duties," Vice Chairman Le Khac Nam emphasized.

Vice Chairman Le Khac Nam expressed his hope that through this conference, members of the city's Legal Dissemination and Education Coordination Council, district and municipal Legal Dissemination and Education Councils, and legal lecturers at all levels will focus on acquiring knowledge to continue effectively disseminating the Land Law at the grassroots level, thereby quickly bringing the law's provisions into practical application.
During his presentation at the conference, Deputy Minister of MONRE, Le Minh Ngan, highlighted that the 2024 Land Law is a significant piece of legislation, impacting all aspects of the country's socio-economic life, national defense, security, and environmental protection. The government presented to the National Assembly at the 7th session of the 15th National Assembly the draft Law amending and supplementing certain articles of the Land Law No. 31/2024/QH15, the Housing Law No. 27/2023/QH15, the Real Estate Business Law No. 29/2023/QH15, and the Credit Institutions Law No. 32/2024/QH1501/8/2024, with an expected effective date of August 1, 2024, five months earlier than initially planned.
According to Deputy Minister Le Minh Ngan, in recent times, following the Prime Minister's directives, MONRE and other relevant ministries and agencies have developed guiding documents within their jurisdiction and disseminated them in various forms to ensure that the Land Law will be promptly enforced when it comes into effect. To date, the guiding documents issued by MONRE and related ministries have been largely completed according to the Prime Minister's requirements, ensuring the law's timely application.

Introducing the key updates and important provisions of the 2024 Land Law, Deputy Minister Le Minh Ngan noted that the new law represents a comprehensive reform compared to the 2013 Land Law, consisting of 16 chapters and 260 articles. It revises and supplements 180 out of 212 articles of the 2013 Land Law and introduces 78 new articles.
The law clarifies the responsibilities of state agencies in exercising land ownership rights, distinguishes the duties and powers of agencies performing state management functions over land, and decentralizes authority while ensuring the control and supervision of implementation to maintain unified management from the central to local levels. It also outlines the state's responsibilities and guarantees for land users.
Notably, chapter VI on land recovery and requisition (comprising 13 articles, from Article 78 to Article 90) specifies cases where the state recovers land for socio-economic development for national and public interests, including projects for constructing public works, government office buildings, and public service facilities. The law also includes various criteria for other cases, such as housing, production areas, land fund development, mineral extraction, underground works, and land recovery for auction or bidding to increase state revenue.
Through this, the legal framework and policies on land have been completed to align with the socialist-oriented market economy. The law addresses overlapping and conflicting policies and laws related to land, resolves practical challenges in land management and usage, and enhances land management in terms of area, quality, and economic value. The 2024 Land Law ensures a harmonious balance between the rights and interests of the state, land users, and investors.

This will create a comprehensive legal framework for implementation, enabling the city to develop socio-economically while ensuring national defense and security when the National Assembly approves the early enforcement of the law on August 1, 2024.
