Ha Nam trains and disseminates new points of the 2024 Land Law
28/07/2024TN&MTA training conference to disseminate the new points of the 2024 Land Law and Decree No. 12/2024/ND-CP, dated February 5, 2024, by the Government, was organized by the People's Committee of Ha Nam Province on May 17 in Phu Ly City, Ha Nam Province. The conference was held both in person and online, with nearly 130 connection points. Attendees included Deputy Minister of Natural Resources and Environment Le Minh Ngan, Deputy Secretary of the Provincial Party Committee, Chairman of Ha Nam Provincial People's Committee, and Head of the Provincial National Assembly Delegation Truong Quoc Huy.
The conference also saw the participation of members of the Provincial Party Standing Committee, the Provincial People's Council, leaders of the Provincial People's Committee, members of the Provincial Party Executive Committee, leaders of the Provincial Party's mass mobilization agencies, leaders of the Vietnam Fatherland Front Committee of the province, leaders of provincial departments, agencies, and mass organizations, standing members of district-level Party Committees and People's Councils, leaders of district-level People's Committees, and leaders of commune, ward, and town-level Party Committees, People's Councils, and People's Committees in Ha Nam Province.

In his opening remarks, Vice Chairman of the Ha Nam Provincial People's Committee, Nguyen Duc Vuong, remarked that the 2013 Land Law had basically created a unified legal framework with strict procedures. However, after nearly 10 years of implementation, the 2013 Land Law revealed several shortcomings and inconsistencies with other related legal systems, and some new practical issues emerged that were not covered by the law.
To address these issues, on January 18, 2024, during its 5th extraordinary session, the 15th National Assembly passed the 2024 Land Law, which will take effect on January 1, 2025, with many significant new points.

Immediately after the 2024 Land Law was enacted, the Government, the Ministry of Natural Resources and Environment, and central agencies proactively developed subordinate legislation. On February 5, 2024, the Government issued Decree No. 12/2024/ND-CP on land pricing, promptly resolving difficulties in land valuation at the local level and promoting land resources for socio-economic development. The decree detailed new provisions on land pricing methods, specific land prices, the selection of land price appraisal organizations, and the establishment of land price appraisal councils.

According to Vice Chairman Nguyen Duc Vuong, land is an important resource for socio-economic development but also presents many complex and challenging issues. To ensure the timely, synchronized, and effective implementation of the 2024 Land Law and new land pricing regulations, the Ha Nam Provincial People's Committee issued Plan No. 755/KH-UBND for the implementation of the 2024 Land Law. The plan directs agencies, units, and localities within the province to review and develop implementation documents, and to propagate and train on the 2024 Land Law and its guiding documents.
Vice Chairman Nguyen Duc Vuong emphasized the importance and necessity of the training conference to equip participants with the basic knowledge required to implement the 2024 Land Law effectively. He urged attendees to seriously and fully absorb the training contents presented by the Ministry of Natural Resources and Environment's leaders and experts, and to actively discuss to gain a deeper understanding and effectively apply the law in land management and use.
In his address, Deputy Minister of Natural Resources and Environment Le Minh Ngan mentioned that the 2024 Land Law is a crucial law impacting all aspects of socio-economic life, national defense, security, and environmental protection. To ensure the law's timely implementation, the Prime Minister directed the Ministry of Natural Resources and Environment to propose a resolution for the National Assembly to enforce the law by July 1, 2024.

Additionally, the Prime Minister instructed the Ministry of Natural Resources and Environment and relevant ministries to develop guiding documents and disseminate the law in various forms to ensure its timely implementation. So far, the guiding documents drafted by the Ministry and other ministries have been largely completed as required by the Prime Minister.
Introducing the main contents of the 2024 Land Law, Deputy Minister Le Minh Ngan highlighted its comprehensive revisions compared to the 2013 Land Law, featuring 16 chapters and 260 articles, including amendments to 180 out of 212 articles of the 2013 Land Law and 78 new articles.
Significant changes include allowing individuals to expand their agricultural land use rights up to 15 times the allocation limit for each type of land, new regulations on agricultural land concentration and accumulation, specific provisions for 31 cases of land recovery for national and public interest, and the delegation of authority to provincial People's Councils for approving the conversion of rice land, protection forest land, and special-use forest land instead of the Prime Minister based on specific area scales as per the current Land Law. The law also abolishes the land price framework and specifies the establishment of land price tables, and defines procedures for land allocation and lease through land use rights auctions for clean land created by the state, or through bidding for projects using land; and no longer allocates land to households.
Notably, the 2024 Land Law inherits and improves regulations on land use principles, adds principles for land protection and climate change adaptation, specifies the responsibilities of those assigned land management by the state, and encourages efficient land use, agricultural and forestry land concentration, and infrastructure development to enhance land value.
The law also addresses social policy beneficiaries and direct agricultural producers and ensures that the steps for compensation, support, and resettlement in land recovery involve public participation, guaranteeing that affected people receive compensation and resettlement before land recovery, ensuring their living standards are equal to or better than before. It also ensures that asset owners, who are not land users, and those affected by land recovery are informed when the state recovers land.
These changes aim to perfect the legal framework and policies on land management in line with the socialist-oriented market economy, resolve overlaps and contradictions in related policies and laws, and address practical issues in land management and use. Additionally, the law enhances land management in terms of area, quality, and economic value, ensuring a balance of rights and interests among the state, land users, and investors.
Moreover, the law promotes the commercialization of land use rights, the development of a transparent and healthy real estate market, the establishment of a modern, transparent, and efficient land management system, the simplification of administrative procedures, digital transformation, and the improvement of land access indicators. It also enhances democracy and reduces land-related complaints.
Deputy Minister Le Minh Ngan also requested the Ha Nam Provincial People's Committee to direct specialized agencies to develop documents under their authority as specified in the 2024 Land Law and to contribute to the drafting of guiding documents to ensure the law's timely implementation.
Concluding the conference, on behalf of the Ha Nam Provincial People's Committee, Deputy Secretary of the Provincial Party Committee and Chairman of the Ha Nam Provincial People's Committee, Truong Quoc Huy, expressed gratitude to the Ministry of Natural Resources and Environment for conveying the key contents of the 2024 Land Law, a significant law affecting the socio-economic life, residents, and businesses.
Chairman of the Ha Nam People's Committee, Truong Quoc Huy, suggested that after the conference, provincial departments, sectors, and localities continue to study the 2024 Land Law, promptly and widely disseminate it among all population strata in the province, and contribute to standardizing and legally compliant land management in Ha Nam.
